Text Message (SMS) Opt-In Consent Policy
1. Purpose
This policy explains how Wellcare Therapy Group, Inc. (“Wellcare,” “we,” “our,” or “us”) obtains, documents, and manages client consent to receive text message (SMS) communications. Our goal is to ensure clients clearly understand what they are consenting to and how their preferences are respected.
2. Scope
This policy applies to:
- Clients and prospective clients of Wellcare Therapy Group, Inc.
- Legal guardians of minor clients
- Authorized client representatives
- Wellcare employees involved in client communications
3. Types of Text Messages Sent
Clients who opt in may receive SMS messages for:
- Appointment reminders and confirmations
- Scheduling updates, cancellations, or waitlist notifications
- Practice closures or emergency notifications
- General administrative communications necessary for care delivery
We do not send marketing text messages unless expressly permitted by law and separately authorized.
4. Privacy & Confidentiality
- Text messages may not be fully secure and may be viewed by others who have access to your device or phone plan.
- Wellcare will not send sensitive clinical details or therapy content via SMS.
- We comply with HIPAA and applicable state privacy laws to the extent feasible within SMS limitations.
- Clients are responsible for safeguarding their personal devices and phone access.
5. Consent Requirements
Consent must be voluntary, informed, and documented. Clients must understand:
- What types of messages they will receive
- That message and data rates may apply depending on their mobile plan
- That they may withdraw consent at any time
Consent cannot be assumed and will not affect access to clinical services unless SMS communication is essential to providing care (e.g., confirming appointments).
6. How Consent Is Obtained
Consent may be obtained:
- During intake forms
- Verbally, when appropriate and documented in the client record
By opting in, the client confirms the phone number provided belongs to them or they have authority to use it.
7. Withdrawing Consent (Opt-Out)
Clients may revoke SMS consent at any time without penalty.
Opt-out options include:
- Replying STOP to any Wellcare text message
- Notifying the office by phone or email
- Informing staff verbally (which will be documented)
Once opt-out is received, Wellcare will discontinue SMS communications except where required by law or critical to client safety.
8. Recordkeeping
Wellcare will maintain documentation of:
- The client’s consent to receive SMS
- Date consent was granted
- Content categories consented to
- Any changes or opt-out requests
